If your clients uses accessWidget and receives a demand letter, reach out to us right away. Receiving a demand letter doesn't mean that the claims are legitimate or well-founded. In fact, they’re often part of “sue-and-settle” tactics, aimed at pressuring businesses into paying settlements, even when their websites meet accessibility standards.
Here’s what you and your clients should do next:
If your client's plan includes Litigation Support (Growth, Scale, and Enterprise)
-
Contact us right away
As soon as you become aware of a potential claim, contact us (support@accessibe.com), ideally within 3 business days. This helps us assess the claim and start the support process promptly. If more than 3 business days have passed, we'll still provide full litigation support, though urgent deadlines may be harder to meet. -
We assess the claim
We'll assign a case manager who will guide your client through the process as we analyze the claim. -
We'll deliver documentation
We'll provide the documentation and support they need within twenty one business days. We can also connect their legal team with a top ADA attorney for consulting.
Important: Litigation support is offered for demand letters received after a license (subject to plan) was purchased and accessWidget was installed on your website.
If your client's on the Micro plan
The proof of effort toolkit compiles key documentation that showcases your commitment to accessibility. These materials serve as proof of your effort to make your website more accessible, demonstrating your commitment to compliance and can help you and your legal team counter a claim and respond appropriately.
Your client's website’s Accessibility Statement is also available through the widget interface on their site, and monthly accessibility audits are sent to their email.
